Bihar: Dalit Girl kidnapped and gang raped at Bhojpur

A 14-year-old Dalit girl was allegedly abducted, tortured, and repeatedly gang-raped in Uttar Pradesh’s Moradabad district.The complainant aunt of the victim alleged that the accused erased and  burned an ‘Om’ tattoo on the minor’s hand with acid, and subjected her to further torture. Bhagatpur police station SHO Sanjay Kumar Panchal said that the girl’s family filed complaint to the police station, alleged gang rape  that during her captivity. “The accused  were Kidnapped the girl and  later taken to the Bhojpur and locked in a  room. The victim  escaped and returned home of  her aunt, a few days ago,” the SHO Panchal. The girl’s family further alleged that the accused was pressuring them to withdraw the case and

Superintendent of police (Rural) Kunwar Akash Singh confirmed that a case has been registered at the Bhagatpur police station under relevant sections of the Bharatiya Nyaya Sanhita, Protection of Children from Sexual Offences (POCSO) Act, and SC/ST(Prevention of Atrocities) Act.

The complainant, the teen’s aunt, alleged that on January 2nd 2025, her niece was kidnapped  while she was on her way to a tailor. “One of the accused, Salman, was arrested on Tuesday in connection with the complaint and subsequently sent to jail. The other three accused fled from the locality and did not arrest yet. The investigation is ongoing,” Police told to media.

There are strong legal framework for the protection of women to  prevent sexual violence, caste prejudice however it difficult for these laws to be implemented. Law enforcement usually uses the Prevention of Atrocities Act insufficiently or ignores it, which reflects prejudices and the intention of shielding Dalits and Adivasis from caste-based violence. Victims of dominant caste abuse frequently have few choices because of the perpetrators’ frequent use of social and political influence to evade justice.

Dalits continued to face systemic violence and caste based discriminations in every nook and corner of the Indian Society.   The rape of a dalit women by a doctor in a private hospital in Uttar Pradesh in August 2024  spotlighted the crimes especially sexual violence by casteist  against Dalit women and girls. Sexual violence against marginalized are very common in U.P that includes  physical assault, verbal abuse, sexual harassment and assault, rape, sexual exploitation, forced prostitution, kidnapping and abduction, child sexual abuse.

Where the male perpetrator has some social or economic hold over the woman, such as her employer, or simply belongs to a dominant caste, then this violence sometimes developed into regular, coerced or induced sexual encounters or sexual exploitation.

There where violence occurs against Dalit women and against other marginalised women are seen to be accessible in both public and private places.  The reality  is that they are denied  free life every where including their private spaces like home etc. they denied their rights to privacy and security of life by the oppressor’s . The majority of Dalit women face violence in public spaces including streets, public toilet, schools, work place, etc. also  including  their own places, villages or towns.

The violence committed against them indicates both their specific vulnerability outside of the home, as well as the element of combined individual and collective community punishment meted out through particularly public physical assaults and verbal abuse. Many Dalit women perceive additional humiliation of public violence they face from dominant castes most of the time, as compared to the generally more private nature of violence committed against other women.
